Why in the news?<\/strong><\/span><\/h5>\r\n
    \r\n
  • The Member of parliament from Ladakh asked for safeguard for land, employment and cultural identity provided under the 6th Schedule of the constitution.<\/span><\/li>\r\n<\/ul>\r\n

     <\/p>\r\n

    Background: <\/strong><\/span><\/h5>\r\n
      \r\n
    • The central government stripped the erstwhile state of Jammu and Kashmir special status and bifurcated it into two union territories.<\/span><\/li>\r\n
    • The demand came in the backdrop of the complete shutdown demanding statehood and protection for land and jobs.<\/span><\/li>\r\n<\/ul>\r\n

       <\/p>\r\n

      Demands:<\/strong><\/span><\/h5>\r\n
        \r\n
      • Amend the Ladakh Hill Development Council (LAHDC) Act, passed in 1997.<\/span><\/li>\r\n
      • Role and responsibility of the Central Government, UT Administration and the Lieutenant-Governor need to be defined.<\/span><\/li>\r\n
      • Role of gram panchayats and town councils also need to be streamlined.<\/span><\/li>\r\n
      • The LAHDC Act needs to be amended for safeguarding land, employment and cultural identity as provided under the 6th Schedule of the constitution to the certain regions of Northeast.<\/span><\/li>\r\n<\/ul>\r\n

         <\/p>\r\n

        Center’s response<\/strong><\/span><\/h5>\r\n
          \r\n
        • The Home Ministry announced the formation of a committee to find a solution to issues associated with preservation of Ladakh’s land, culture and language apart from demands from the region to have it included under the Sixth Schedule of the Constitution.<\/span><\/li>\r\n
        • The National Commission for Scheduled Tribes recommended the inclusion of Ladakh under the Sixth Schedule because:<\/span>\r\n
            \r\n
          • Ladakh is predominantly a tribal region in the country, almost 97 percent of the population belongs to tribes such as:<\/span>\r\n
              \r\n
            • Balti<\/span><\/li>\r\n
            • Drokpa<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n
            • People in Ladakh region also had some agrarian rights which included rights on land and restriction on non-residents to purchase\/acquire land in Ladakh.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

               <\/p>\r\n

              About Schedule 6th of the Indian Constitution:<\/strong><\/span><\/h5>\r\n
                \r\n
              • The 6th Schedule of the constitution (Article 244(2) and 275(1)) has a provision for the administration of the several tribal areas in Northeast states (Assam, Meghalaya, Tripura and Mizoram).<\/span><\/li>\r\n
              • It gives greater political autonomy in some of the tribal areas of Northeast.<\/span><\/li>\r\n
              • Under it autonomous districts and councils are administered by the elected representatives.<\/span>\r\n
                  \r\n
                • They also have a varying degree of autonomy to frame laws and protect the interests of their tribal people.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n
                • Under this schedule the executive power of the Schedule area remains within executive authority of the state.<\/span><\/li>\r\n
                • Governors of the above mentioned states are empowered to reorganize the boundaries of the tribal areas.<\/span>\r\n
                    \r\n
                  • S\/he may choose to include\/exclude any areas<\/span><\/li>\r\n
                  • Combine two or more autonomous districts.<\/span><\/li>\r\n
                  • Alter or change names of these regions without passing separate legislation for the same.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

                     <\/p>\r\n

                    Autonomous District Councils (ADCs)<\/strong><\/span><\/h5>\r\n
                      \r\n
                    • Elected members hold office for 5 years from the date appointed.<\/span><\/li>\r\n
                    • Each autonomous district and regional council consists of not more than 30 members of which;<\/span>\r\n
                        \r\n
                      • 4 are nominated by the governor of the state<\/span><\/li>\r\n
                      • Rest are elected via elections<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n
                      • Bodoland territorial council, however, is an exception as it can set up 46 members out of which 40 are elected.<\/span><\/li>\r\n
                      • The ADCs are empowered with several civil and judicial powers, and can constitute village courts within their jurisdiction to hear trials of cases involving the tribes.<\/span><\/li>\r\n
                      • Governors of states under the sixth schedule specifies the high court jurisdiction of the for each of these cases.<\/span><\/li>\r\n
                      • ADCs are empowered to make laws on the following matters with the approval of the governor.<\/span>\r\n
                          \r\n
                        • Land<\/span><\/li>\r\n
                        • Forests<\/span><\/li>\r\n
                        • Fisheries<\/span><\/li>\r\n
                        • Social Security<\/span><\/li>\r\n
                        • Entertainment<\/span><\/li>\r\n
                        • Public Health etc.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n
                        • Act passed by the state legislature and parliament may or may not be levied in these regions unless the president and governor giver his\/her assent with or without modifications in the laws for the autonomous regions.<\/span><\/li>\r\n<\/ul>\r\n
