\r\n\r\nBill on Enhanced Pension for Retired Judges Got Both House Approval<\/strong><\/span><\/h4>\r\n<\/td>\r\n<\/tr>\r\n<\/tbody>\r\n<\/table>\r\n <\/h5>\r\nWhy in the news?<\/span><\/span><\/strong><\/h5>\r\n\r\n- Rajya Sabha also approved the High court and Supreme Court Judges (Salaries and Conditions of Service) Amendment Bill, 2021.<\/span><\/li>\r\n<\/ul>\r\n
<\/p>\r\n Background<\/strong><\/span><\/h5>\r\n\r\n- The bill was passed by the Lok Sabha earlier, the bill was sent back without opposition to the lower house as it is a Money bill and thus passed by Parliament.<\/span><\/li>\r\n<\/ul>\r\n
<\/p>\r\n Objective:<\/strong><\/span><\/h5>\r\n\r\n- It will bring clarity on the qualification of additional pension quantum or family pension on attaining a certain age for retired judges.<\/span><\/li>\r\n<\/ul>\r\n
<\/p>\r\n Salient features of the Bill<\/strong><\/span><\/h5>\r\n\r\n- It proposes to add an explanation in section 17B of the High court judges act and in section 16B of the Supreme Court Judges Act to clarify the intention of the government.<\/span><\/li>\r\n
- The bill seeks to revise the Sumptuary allowance paid to judges of the High Court and the Supreme Court to compensate for expenses incurred on account of entertaining visitors with effect from September 2017<\/span><\/li>\r\n
- High Court and Supreme Court Judges were entitled to use an official residence without payment of rent and if these allowances are not used by the judges, then they will be paid 30% allowance of their salary.<\/span>\r\n
\r\n- The bill seeks to revise this allowance to 24% of the salary.<\/span><\/li>\r\n
- It also specifies that 27% of salary if dearness allowance (DA) crosses 25% and 30% of salary when DA crosses 50%.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n

\r\n- Judges previously held a pensionable post under the central or state government.<\/span><\/li>\r\n

- The bill also seeks to revise the cap on the maximum pension payable to these judges.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

- The salaries and allowances of the judges of the Supreme Court are charged upon the Consolidated Funds of India.<\/span><\/li>\r\n
- The pensions of the judges of the Supreme Court are charged upon the Consolidated Funds of India.<\/span><\/li>\r\n
- The salaries, allowances, privileges, leave and pension of the judges of the Supreme Court are determined from time to time by the Parliament.<\/span><\/li>\r\n
- They cannot be varied to their disadvantage after their appointment except during a financial emergency.<\/span><\/li>\r\n
