Why in the news?<\/strong><\/span><\/h5>\r\n
    \r\n
  • Recently the Jammu and Kashmir Delimitation Commission<\/strong> suggested increasing the total 7 seats for the UT i.e 6 seats for Jammu division and 1 seat for Kashmir division.<\/span><\/li>\r\n<\/ul>\r\n

    Background:<\/strong><\/span><\/h5>\r\n
      \r\n
    • Jammu division currently has 37 seats while Kashmir currently has 46 seats.<\/span><\/li>\r\n
    • The 3 member Delimitation commission was constituted in March 2020. It was specially for J&K by the Parliament Act under the provisions of Part V of J&K Reorganisation Act, 2019.<\/strong> It’s term is going to end in March 2022.<\/span><\/li>\r\n<\/ul>\r\n

      Key Highlights of the Delimitation Commission Draft:<\/strong><\/span><\/h5>\r\n
        \r\n
      • 16 seats are reserved for SC and ST in the UT. 9 seats are given to ST while 7 seats are given to SC.<\/span><\/li>\r\n
      • It has not specified the districts where these SC and ST seats would be reserved.<\/span><\/li>\r\n
      • Carving out new seats was done on the basis of the 2011 Census.<\/span><\/li>\r\n
      • Jammu and Kashmir will now have 90 seats in the Legislative Assembly.<\/span><\/li>\r\n
      • The commission has also proposed for some of the districts an additional constituency to balance the representation of geographical areas having bad internet connectivity and communication as well as lack of Public convenience.<\/span><\/li>\r\n
      • The commission has categorized the 20 districts into three broad categories:<\/span>\r\n
          \r\n
        • A, B and C<\/span><\/li>\r\n
        • Giving the margin of 10% of the average population per constituency while allocating seats to the districts.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

          • The Supreme Court ruling has already granted the status quo with respect to delimitation, if the commission prepares a draft based on the 2011 census.<\/span><\/li>\r\n<\/ul>\r\n

            • It is defined as the process\/act of fixing the boundaries\/limit of the territorial constituencies in a country done at the particular time period due to the change in the population.<\/span><\/li>\r\n<\/ul>\r\n

              • To give equal representation to the equal segments of a population.<\/span><\/li>\r\n
              • In order to curb the political parties' advantage over other fair distribution of geographical areas.<\/span><\/li>\r\n
              • To keep up the principle of One vote One value.<\/span><\/li>\r\n<\/ul>\r\n

                Process of Delimitation<\/strong><\/span><\/h5>\r\n
                  \r\n
                • Article 82 empowers the parliament to enact a Delimitation Act after every census.<\/span><\/li>\r\n
                • States are also divided into territorial constituencies as per Delimitation Act after every census under Article 170.<\/span><\/li>\r\n
                • Once the act is in force the central government set up a Delimitation Commission.<\/span><\/li>\r\n
                • First Delimitation exercise was carried out in 1950-51 by the President (with the help of the Election Commission).<\/span><\/li>\r\n
                • It has been set up four times post independence i.e., 1952, 1963, 1973 and 2002.<\/span><\/li>\r\n
                • There was no delimitation after the 1981 and 1991 census.<\/span><\/li>\r\n<\/ul>\r\n

                  • It is appointed by the President of India and work in coordination with the Election Commission of India.<\/span><\/li>\r\n

                    • Chief Election Commissioner<\/span><\/li>\r\n

                      • In order to fix numbers and boundaries of the constituencies to make the population of all constituencies nearly equal.<\/span><\/li>\r\n
                      • In order to identify seats reserved for SC and ST relative to their proportion of population.<\/span><\/li>\r\n
                      • It is high power body whose orders and decisions have the force of law and cannot be called in questions before any court.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n
